These Terms and Conditions govern your use of the CallLibrary™ service and website. The Service is provided by CallLibrary and is offered to you (hereinafter referred to as "Subscriber") as per your agreement with and acceptance of this document (hereinafter referred to as "Membership"). By clicking the box entitled "I have read and accept the Terms and Conditions of Use" as part of the registration process, members accept all items in the Terms and Conditions and agree to abide by and be legally bound by the Terms and Conditions. By browsing, visiting and using the CallLibrary™ website, you accept and agree to abide by these Terms and Conditions of Use. If you do not agree to these Terms and Conditions of Use, you should not use the CallLibrary™ service or website.

CallLibrary™ reserves the right, with or without notice, to change these Terms and Conditions in its sole and absolute discretion. The most current version of these Terms and Conditions supersedes all previous versions and can be viewed by clicking on the "Terms and Conditions" link at the bottom of the pages of CallLibrary™ website.

Any personal information submitted on the CallLibrary™ website is subject to our Privacy Policy, the terms of which are incorporated herein. Please review our Privacy Policy to understand our practices. Our privacy policy can be viewed by clicking on the "Privacy policy" link at the bottom of the pages of CallLibrary™ website.

CallLibrary™ is an online subscription based rental service that allows its subscribers to rent books through its website located at http://www.CallLibrary.com To use CallLibrary™, subscriber will have to register with CallLibrary.com™ to create an account. A subscriber can then browse/search books a subscriber would like to read, and adds them to his/her Queue. Once payment has been received at the time of delivery, the first set of books will be delivered to the subscriber at the shipping address provided at the time of registration. CallLibrary™ rents out two (2) books at a time. Once you are done with the first set of books, go to www.calllibrary.com and navigate to "My Account" tab and click on "Queue". Queue will display all your interested books. Now check the check box of the book that you would like to read next and press “Issue” Button.

Upon becoming a CallLibrary™ subscriber, subscribers become responsible for paying periodic subscription fees according to the then current billing terms and subscription plan. Subscription fees are non-refundable.

Subscriptions are automatically renewed, and the subscriber will be billed the subscription fee at the beginning of the new subscription period.

By using the CallLibrary™ service, you are expressly agreeing that we are permitted to bill you subscription fee, any applicable taxes and any other charges you may incur in connection with your use of the CallLibrary™ service. Additional charges may include books you fail to return, or a billing plan change you request. As used in these Terms and Conditions, "billing" shall indicate either a charge or debit, as applicable, against your Payment Method. The subscription fee will be billed at the beginning of your subscription and on each subscription renewal thereafter unless you cancel your membership. We will automatically bill your Payment Method on the calendar day corresponding to the commencement of your membership. In the event your membership began on a day not contained in a given month, we will bill your Payment Method on the last day of such month. For example, if you became a paying member on January 31st, your Payment Method would next be billed on February 28th. All fees and charges are non-refundable and there are no refunds or credits for partially used periods. We may change the fees and charges in effect, or add new fees and charges from time to time, but we will give you advance notice of these changes by email.

In case the bills are not paid as on the due date, your account will be suspended and you will not receive any further books, till such time the payment is made. In case of your account suspension, you will have to return the books with you within seven (7) days.

A subscriber may change plans at any time. Upgrades in plans will only result in billing the difference of the plans. Downgrades in plans will affect the next billing cycle. No refunds for partial months of use will be credited. Future billing cycles will be billed at the new rate.

Subscribers may keep their rented books as long as they wish, provided the subscriber's account is in good standing and the subscription fee has been paid. If subscription fee is not paid, CallLibrary™ will ask you to return the books within seven (7) days.

Your subscription may be cancelled at any time by calling or emailing CallLibrary™ customer service. The cancellation will take effect immediately if you do not have any books in your possession. Otherwise, the cancellation will become effective once all CallLibrary™ books in your possession are returned. We do not provide refunds or credits for any partial-month subscription periods. If you fail to return the books within seven (7) days, you will be charged the market value for each book.

CallLibrary™ reserves the right to cancel your subscription without prior notice and without assigning any reasons.

Upon cancellation of membership, we will refund your security deposit after ensuring all outstanding charges applicable have been processed. We will issue a bank cheque in the name of the subscriber, within fifteen working days. The cheque will be mailed to the shipping address as provided by you in your account information.

CallLibrary™ handles shipping using our own delivery agents, or in partnership with a logistics provider. We will fulfill a delivery request with in maximum 2 business days of receiving a delivery request from the subscriber. CallLibrary™ rents out two (2) books at a time. At the time of delivery of books, our delivery agent or logistics provider will collect the previous set of books. Subscriber must return all the previously rented books before receiving the next set of books.

All books sent to a subscriber are verified to be in a good condition prior to dispatch and condition of each book is recorded in our system. Upon receipt of the books, you must ensure that the books are in good condition. Any damage, if found, must be reported to our representative and conveyed to CallLibrary™ customer service via email or phone. At the time of pick-up, our representative will check for any damage to the books and will intimate you accordingly. Upon receipt of the books,we will verify the condition of the book against the condition recorded in our system before dispatch.

If a book is returned to CallLibrary™ damaged as a result of subscriber misuse, CallLibrary™ will charge you the market value of each damaged book and book will return to subscriber. If CallLibrary™ determines that a book was damaged during transit, CallLibrary™ will not charge subscriber for the damaged book.

Your CallLibrary™ membership will continue in effect unless you cancel your membership or we terminate it. You must cancel your membership before it renews each month in order to avoid billing of the next month's membership fees to your Payment Method. We will bill the membership fee plus any applicable tax to the Payment Method you provide to us during registration (or to a different Payment Method if you change your account information)

The CallLibrary™ service and Website and its contents are provided "as is" and we make no representations or warranties of any kind with respect to the CallLibrary™ Website, its contents or our service. We assume no liability or responsibility for any errors or omissions in the content of the CallLibrary™ website, any failures, delays, or interruptions in the shipment of books, delivery of any content contained on the CallLibrary™ Website, any losses or damages arising from the use of the content provided on the CallLibrary™ website, or any conduct by users of the CallLibrary™ service or website. We disclaim all representations and warranties, including, for example, warranties of merchantability, fitness for a particular purpose, and non-infringement. In addition, we do not represent or warrant that the information accessible via our site is accurate, complete or current.

In no event shall CallLibrary™, its proprietors, shareholders, directors, officers, or employees be liable (jointly or severally) to you for any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever resulting from loss of use, data or profits, whether or not advised of the possibility of damage, and on any theory of liability, arising out of or in connection with the use of the CallLibrary™ Website, its contents or our service. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law.

All contents included on the CallLibrary™ website and delivered to you as part of the CallLibrary™ services, including the books themselves, are the property of CallLibrary™, its suppliers, or its advertisers, and are protected by India and international copyright laws. The compilation of the content on this website is the exclusive property of CallLibrary™, and protected by Indian and international copyright laws.

CallLibrary™, CallLibrary.com™, The CallLibrary™ design logo, and all page headers, custom graphics and button icons are service marks, trademarks, and/or trade dress of CallLibrary™. All other trademarks, product names and company names or logos cited herein are the property of their respective owners.

• You must be eighteen years of age or older to subscribe to the  CallLibrary™ service.
• The CallLibrary™ website and its content are for your personal, non-commercial use. You may not download, copy, distribute, transmit, display, perform, publish, license, create derivative works from, or offer for sale any CallLibrary™ content without its express written consent.
• You agree to use the CallLibrary™ website and any associated service in accordance with all applicable laws, rules and regulations.
• CallLibrary™ reserves the right to immediately terminate your subscription to utilize its website as a result of any unauthorized or illegal use, the contents of its website, and/or any associated service should CallLibrary™ become aware of that unauthorized or illegal use. This right to terminate includes, but is not limited to, CallLibrary™ right to terminate your subscription if it determines subscriber abuse of CallLibrary™ policies and procedures.

You are solely responsible for maintaining the confidentiality and security of your account information and your password. If you reveal your password or share your account with anyone, you take full responsibility for his/her actions.

You agree to indemnify and hold harmless CallLibrary™ and its proprietor, directors, officers, employees, agents or other representatives from and against all claims, liability and expenses, including all legal fees and costs arising from or relating to (a) your breach of these Terms and Conditions; and (b) your use of this website and associated services including transmission or placement of information or material by you on this website. This provision shall survive the termination of your right to use this website and/or your status as a CallLibrary™ subscriber.

This website may include inaccuracies or typographical errors that may be corrected as they are discovered at CallLibrary™ sole discretion.

CallLibrary™ distributes content supplied by third parties. CallLibrary™ has no editorial control over content supplied by third parties. Any opinions, advice, statements, services, offers, or other information expressed or made available by third parties, including third party content providers, advertisers, merchants, sponsors, licensors, or any other user of CallLibrary™ are those of the respective authors or distributors and not of CallLibrary™ or its affiliates, or any of their respective proprietors, officers, directors, employees or agents.
